Terms of Service

These terms form a contract between you and WalnutZite platform owner ("we", "us"). By signing up for or using WalnutZite, you accept these terms. If you sign up on behalf of an organization, you represent that you have the authority to bind it.

1. The service

WalnutZite is a subscription website-building and hosting service. It includes a page builder, modules such as a blog, store, and booking system, and publishes your website on a subdomain we provide or on your own domain.

2. User accounts

• You must provide accurate and current information when signing up.
• You are responsible for safeguarding your password and for all activity that occurs under your account.
• If you discover unauthorized access to your account, you must notify us immediately at walnutzite@gmail.com
• Certain website addresses (subdomains) are reserved for our system and brand.

3. Free trial and payment

• New accounts get a 14-day full-feature trial with no credit card required.
• Paid service comes in two plans: Full Website (unlimited pages) and Landing Page (up to 1 page). Each plan is billed per website per year, and a website can be on only one plan at a time. Additional capabilities and storage can be purchased as add-ons on top of your plan: a Full Website plan can purchase any add-on currently on sale, while a Landing Page plan can purchase only the add-ons we have enabled for that plan.
• When the trial ends, if you have not subscribed, your website's publication is suspended. Visitors will see a page stating the website has expired. There is no free plan to continue on.
• Your data is retained for a period after suspension and can be restored on payment. Once that period has passed, the data is permanently deleted. Retention period details are in the Privacy Policy.
• Fees are paid in advance annually per website and renew automatically every year on the same date until you cancel. We will always send an email reminder before each charge date.
• If a charge fails, your website continues to be published normally for another 30 days so you can fix your payment method. We will retry the charge and send reminders during this period. If the charge still has not succeeded after 30 days, the website's publication is suspended and it enters the retention period described above.
• After suspension, within the first 90 days you can pay the normal fee to restore service immediately. From day 91 through day 365, restoration is still possible but carries a restoration fee in addition to the annual fee. We will always show you the total amount before you pay.
• Prices shown exclude VAT unless stated otherwise.
• If we change prices, we will give at least 60 days' notice. The price you subscribed at stays fixed for the term of that subscription; the new price applies to new subscriptions.

4. Cancellation and refunds

• You can cancel at any time from your account dashboard. Cancelling stops the next billing charge immediately, and you retain service through the end of the billing period you already paid for.
• We do not refund partially used billing periods, unless consumer protection law requires otherwise.
• If we terminate the service through no fault of yours, we will refund a pro-rated amount for the remaining period.

5. Content and ownership

• Your content remains yours. Text, images, products, and data you upload remain entirely your property.
• You grant us only the rights necessary to store, copy, and publish that content solely to provide the service to you. This license ends when you delete the content or close your account.
• The software, user interface, templates, and trademarks of WalnutZite remain ours.
• You may export your content at any time while your account is active.

6. Acceptable use

You may not use the service to:

• Do anything unlawful under Thai law or any law applicable to you
• Infringe the copyright, trademark, or other rights of others
• Distribute malware, phish, defraud, or send spam
• Sell unlawful goods or services
• Attempt to breach the system, probe for vulnerabilities without authorization, or place unreasonable load on the system
• Use system resources in a way that materially affects other users

If we find a violation, we may suspend or terminate your account. For a violation that is not severe and can be remedied, we will warn you and give you time to fix it first, except in urgent cases that affect security or other users.

7. Personal data

Processing of personal data is governed by ourPrivacy Policy, which is incorporated into these terms.

If your website collects personal data from visitors — for example through a contact form or orders —you are the data controller for those people by law, and you have a duty to publish your own website's privacy policy, obtain consent where necessary, and respond to data subjects' rights requests. We act only as a data processor on your instructions.

8. Availability and service changes

We aim to provide continuous service but do not guarantee it will be uninterrupted or error-free. Planned maintenance is announced in advance whenever possible. If we discontinue a significant feature, we will give at least 30 days' notice.

9. Limitation of liability

The service is provided as-is. To the maximum extent permitted by law, we are not liable for indirect damages, consequential damages, loss of profit, or loss of data, and our total liability in any case will not exceed the fees you actually paid in the 12 months before the event occurred.

This limitation does not apply to liability the law does not permit to be limited, such as willful misconduct or gross negligence, and does not affect your rights under consumer protection law.

You are responsible for the content on your own website, and you agree to indemnify us against any third-party claim arising from your content or your use of the service in violation of these terms or the law.

10. Account termination

If your account is terminated, by either party, your website will stop being served, and data will be deleted according to the retention periods in the Privacy Policy. We recommend exporting your content before closing your account.

11. Changes to these terms

If we make a material change, we will give at least 30 days' notice. If you do not accept the change, you may cancel the service before it takes effect. Continuing to use the service after that date constitutes acceptance of the new terms.

12. Governing law

These terms are governed by Thai law, and Thai courts have jurisdiction over any dispute. We encourage you to contact us at walnutzite@gmail.com to seek a resolution together before taking legal action.
